Closing Technology & Services, Inc. dba The Closing Exchange ('we', 'our', 'us', or 'TCX') is committed to protecting the privacy of users ('Users') of TCX's services, products and materials as well as TCX's websites www.theclosingexchange.com and https://cxchoice.com/ (collectively, "Services"). This Privacy Policy describes TCX's treatment of personally identifiable information ("Personal Information") that TCX may obtain when you are registering on or accessing TCX's websites or when you use TCX's Services. This Privacy Policy covers TCX's treatment of any Personal Information that TCX's business partners share with TCX. This Privacy Policy applies solely to the information that we collect through the Services. This Privacy Policy does not address personal information that you provide to us in other contexts (e.g., through a business relationship not handled through the Services).

Services Provided

TCX provides certain Services, including an online platform and database to assist, for example:

- Companies seeking services to assist their customers in signing documents for various transactions;

- Individuals and entities who are employing a service provider and needing assistance to finalize their documents for various types of transactions;

- Professional vendors seeking to provide their services; and

- Parties related to the transactions who wish to monitor the transaction process.

How Do We Collect Your Personal Information?

Online Platform. At certain parts of our Services, only persons who provide us with the requested Personal Information will be able to utilize our online services or otherwise participate in the Services and our offerings. We receive and store any information you enter on our websites or provide to us in any other way. The type of Personal Information collected may include, but is not limited to, your name, email address, mailing address, and telephone number. The Personal Information you provide may be used for such purposes as sending items, processing payments, responding to your requests for certain products and services, customizing the advertising and content you see, and communicating with you about specials and products.


Online Newsletters Forums and Communities. From the Services, you may now or in the future be able to utilize our online services or subscribe to one of our services such as our online newsletters, or participate in one of our online forums or communities. The types of Personal Information that may be collected at these pages include: name, address, e-mail address, telephone number, fax number, and information about your interests in and use of various products, programs, and services.

Domain Information. From time to time, the Services (and/or third-party services facilitating or supporting the Services) may be configured to collect domain information. How Do We Use Your Personal Information?

We may provide information about you to respond to subpoenas, court orders, legal process or governmental regulations, or to establish or exercise our legal rights or defend against legal claims. We believe it is necessary to share information in order to investigate, prevent or take action regarding illegal activities, suspected fraud, situations involving potential threats to the physical safety of any person, or as otherwise required by law. This includes exchanging information with others for fraud protection and credit risk reduction. In such circumstances, we will take appropriate measures to ensure that the requester understands the sensitive nature of the Personal Information that they may receive.

Business Transfers. We may share your Personal Information with other entities or individuals in connection with the sale, assignment, merger or other transfer of all or a portion of TCX's business to such entities or individuals. We will require any such successors to honor the terms of this Privacy Policy.

Do We Disclose Any Personal Information to Outside Parties?

Unless you expressly give us permission in writing to do so, TCX will not sell, rent, license, or trade your Personal Information other than as specified in this Privacy Policy.

Automatically Collected Information and Anonymous Information

In connection with the Services, TCX and/or third-party service providers may collect some information to improve the overall quality of the User's experience

Aggregated Data. TCX and/or third-party service providers may collect aggregate queries for internal reporting and also count, track, and aggregate the User's activity into an analysis of general traffic-flow. To these ends, TCX and/or third-party service providers may merge information about you into aggregated group data. In some cases, TCX and/or third-party service providers may remove personal identifiers from Personal Information and maintain it in aggregate form that may later be combined with other information to generate anonymous, aggregated statistical information. Such anonymous, group data may be shared on an aggregated basis with TCX's affiliates, business partners, service providers and/or vendors.

Web Server Logs and IP Addresses. An Internet Protocol ("IP") address is a number that automatically identifies the computer or device you have used to access the Internet. The IP address enables us and/or a third-party service provider to send you the web pages that you want to visit, and it may disclose the server owned by your Internet service provider. TCX and/or third-party service providers may use IP addresses to conduct website analyses and performance reviews and to administer the Services.

Cookies and Web Beacons. Periodically, some pages on websites or in connection with the Services may use "cookies," which are small files that the websites place on your hard drive for identification purposes. These files are used for site registration and customization the next time you visit the websites. You should note that cookies cannot read data off of your hard drive. Your web browser may allow you to be notified when you are receiving a cookie, giving you the choice to accept it or not. You can also refuse all cookies by turning them off in your browser. By not accepting cookies, some pages may not fully function and you may not be able to access certain information on the websites. Information that we and/or third-party service providers collect through cookies includes (i) the name and version of the operating system on the User's computer, (ii) the name and version of the User's browser, (iii) which page on the site the User is currently reading, as well as clicks and time spent on a particular page, (iv) if the User was sent to the current page by some other page on the web, the universal resource locator ("URL") of the referring web page, and (v) geolocation of the User's computer or device. Some of the websites' web pages may use web beacons in conjunction with cookies to compile aggregate statistics about the websites' usage. A web beacon is an electronic image (also referred to as an "action tag," "single-pixel," or "clear GIF") that is commonly used to track the traffic patterns of users from one web page to another in order to maximize web traffic flow and to otherwise analyze the effectiveness of the websites. Some web beacons may be unusable if you elect to reject their associated cookies.

Email

TCX and/or third-party service providers may contact or send you communication (e.g., via newsletters or emails). When you receive newsletters or communications, you may indicate to stop receiving further communications from TCX and you will have the opportunity to "opt-out" by following the unsubscribe instructions provided in the email or newsletter you receive or by contacting us directly. Please note that despite your indicated email preferences, we and/or third-party service providers may still contact you in relation to your assignments or any issues relating to any business you conduct with TCX, including notices of any updates to our terms of use or Privacy Policy.

Security

The security of your data is important to TCX. We have implemented appropriate security measures preventing your Personal Information from being accidentally lost, used or accessed in an unauthorized way, altered or disclosed. However, you should know that no website or online platform, including TCX, can fully eliminate security risks associated with Personal Information. While TCX has endeavored to create a secure and reliable website for users, the confidentiality of any communication or material transmitted to/from the Services or our websites or via e-mail cannot be guaranteed.

Children's Privacy Protection

Under Age 13. TCX understands the importance of protecting children's privacy in the interactive online world. Our Services and our websites are not designed for, or intentionally targeted at, children under 13 years of age. It is not our policy to intentionally collect or maintain information about anyone under the age of 13. No one under the age of 13 should submit any Personal Information to TCX, our Services, or our websites.

Under Age 18. Minors under 18 years of age may have the Personal Information (if provided to TCX) deleted by contacting us, at Our Contact Address listed at the end of this policy, requesting deletion. Please note that, while we make reasonable efforts to comply with such requests, deletion of the Personal Information does not ensure complete and comprehensive removal of that data from all systems.

Response to "Do Not Track" Signals

Some Internet browsers include the ability to transmit "Do Not Track" signals. Since uniform standards for "Do Not Track" signals have not yet been adopted, TCX does not process or respond to "Do Not Track" signals.

Deleting or Changing Your Personal Information

We rely on you to update and correct your Personal Information. If we receive, at Our Contact Address listed at the end of this policy, your request to delete your Personal Information, we will use commercially reasonable efforts to honor your request. We may retain an archived copy of your records as required by law or for legitimate business purposes.

Links to Third Party Services

We are not responsible for any websites or services linked to our Services. Your linking to any such websites is at your own risk, and you are responsible for learning about and complying with the terms of usage and other conditions posted on those websites

Changes to this Privacy Policy

This Privacy Policy may be revised from time to time, for example, to address new features or services, new or modified laws, or new or modified business procedures.
